MICRA Under Attack
Today in California, trial lawyers are waging an aggressive campaign on
California’s landmark Medical Injury Compensation Reform Act (MICRA).
California’s trial attorneys recently launched an all-out assault on
California's historic tort reform law, which since 1975 has
helped keep malpractice premiums in-check and ensure that California’s
patients have access to affordable health care.
California's critical MICRA protections are a national success story,
safeguarding patients and their access to care for almost 40 years. Trial
lawyers are backing risky reforms that would impede the ability to provide
critical care for California's most vulnerable citizens.
If successful, the trial attorneys' efforts will cause malpractice rates to
recreate the same conditions that threatened to throw California’s health
care system into crisis during the early 1970s.
Physicians will be victorious in this fight, but in order to do so,
we need your help.
What is MICRA?
The Medical Injury Compensation Reform Act (MICRA) is a series of laws
written to ensure that injured patients are fairly compensated, medical
liability rates are kept in check, and physicians and clinics can remain in
practice treating patients. The law has been targeted by the trial lawyers
because it restricts the amount of money they can collect in damage awards.
Why is MICRA important?
MICRA works to restrain premium rates in California, while states without
liability reform are seeing dramatically higher premiums.
